Family reunification upon obtaining Spanish nationality

Undoubtedly, living in Spain has brought not only benefits but also significant sacrifices. Having moved away from the customs of your country of origin and your friendships is just one of them. However, undoubtedly, the most challenging aspect of all is having had to leave behind your closest relatives.

In this article, we will discuss which family members can be reunified upon obtaining Spanish nationality so that you know whom you can reunify and how you can do it.

What is family reunification?

Family reunification is an immigration procedure through which a foreign person who has a Spanish residence permit can reunify their family members in Spain with a residence and work permit. It is worth noting that family reunification can only be requested by those foreigners who have renewed their initial residence permit, and you must demonstrate that the person you want to reunify is financially dependent on you.

Which relatives are eligible for reunification once you obtain nationality?

  1. Spouse: In this situation, the spouse of a Spanish resident or of any other resident of the European Union residing in Spanish territory. Specifically, the non-separated spouse, either in fact or by law, provided that the marriage has not been entered into fraudulently.
  2. Registered Civil Partnership: The non-EU resident who is the partner of a Spanish resident or of any other resident of the European Union residing in Spanish territory. This applies if the partnership is registered in a Public Registry of Civil Partnerships, whether at the regional or local level, without the possibility of duplicate registration.
  3. Children under 21 years old: Children of a Spanish resident or non-EU resident spouse or registered civil partner of a Spanish or EU resident. This applies provided they have the authorization of the other parent, if any, without the need to demonstrate financial dependence.
  4. Dependent children over 21 years old: Children of a non-EU resident spouse or registered civil partner of a Spanish or EU resident who is over 21 years old and financially dependent solely on the money provided by the Spanish family member.
  5. Dependent Ascendants: This includes the parents, mother-in-law, father-in-law of a Spanish resident or of the spouse or registered civil partner of a Spanish or EU resident residing in Spanish territory. The ascendants must be financially dependent in the country of origin or residence, regardless of their age.
  6. Extended Family: Any relative who, at the time of the application, is financially dependent or living with the Spanish or EU resident residing in Spanish territory. This applies to relatives for whom it is strictly necessary for the resident to personally care for them due to serious health reasons or disability.
  7. Unregistered Common-law Partner: A stable partnership will be considered when it can be proven to have lasted for at least one year of cohabitation, or if there is common descent. Proof of stable cohabitation is sufficient. Once you have been able to bring any of these relatives and they are in Spain with you, you can apply for the Residence Card for Family Members of EU Citizens. This process should be initiated at the Foreigners’ Office of your residence, and once the card is issued, it will be valid for 5 years.
