Non-Lucrative Residence Renewal
The non-lucrative residence permit in Spain is one of the most sought-after options and is widely used by those who want to enjoy and live in the country. When applying for it for the first time, the requirements are much clearer. However, the problem arises when you want to renew it once the initial one-year validity period has passed.
Well, it’s important to know that there are two options for renewing this residence:
- One of them is to extend the validity of our residence permit for another two years. This renewal can be done for two more years once it expires again.
- The other option is to modify the type of residence we have, that is, to switch from a non-lucrative residence to one that allows us to work in addition to residing in Spain.
Renewal of non-lucrative residence: requirements
Although most of the requirements they will ask you for are to demonstrate that you continue to meet the initial requirements and financial solvency, there are certain differences that must be taken into account:
Financial solvency
Financial solvency is one of the most important requirements to obtain this visa.
In your initial application, this translates to 400% of the IPREM for the applicant, and 100% for each additional family member we bring with us.
Legal residence (6 months)
You are required to be a legal resident. That means you must spend more than 183 days per year in Spanish territory. For this reason, if you cannot demonstrate that you have been in the territory for those 6 months when presenting your renewal, your application will likely be rejected.
To prove such residence, you can attach bank statements or invoices, even for utilities like phone or electricity.
It is crucial to note here that the year begins counting from the issuance of the residence card until 365 days later. In other words, it does not coincide with the normal calendar year.
Health insurance for non-lucrative residence
In the first application, it was required to purchase health insurance. Therefore, to obtain the renewal of the residence, it is important to continue maintaining the health insurance you contracted, or if you want to modify it, there is no problem, but it is important to have it.
School-aged minors for the renewal of non-lucrative residence
If you came with your children, you must demonstrate that they are perfectly enrolled in school and attend their corresponding classes regularly.
Certificate of habitability for non-lucrative residence
This certificate demonstrates, based on your housing data, that it meets the necessary conditions for both you and your partner and children when applicable to cohabit.
Compliance with Tax and Social Security for Non-Lucrative Residence Renewal
You must demonstrate that you comply with your obligations to the Tax and Social Security authorities and that you have no outstanding debts.
Criminal and Police Records for Non-Lucrative Residence
Another key requirement is that you have no criminal or police records in Spain.
Documentation for Non-Lucrative Residence Renewal
Here is the documentation you need for the renewal of non-lucrative residence:
- Fully completed application form
- Valid and current passport
- Photocopy of the entire passport
- Documentation demonstrating means of subsistence for the period of the application
- Proof of medical insurance
- If you have minors under your care who are of school age, a report issued by the authorities or the educational institution will be required.
- Proof of payment of the fee
Changing from a Non-Lucrative Residence Permit to a Residence and Work Permit
If you want to start working in the country, you will need to change your permit to a residence and work permit. In this case, you must decide whether you want it to be for self-employment or for employment by others.
Change to Residence and Work Permit for Employment by Others
This type of permit allows you to work for any company in Spain. The main requirement to change to a residence and work permit for employment by others is to have an employment contract, regardless of the sector or position, with a minimum duration of one year and full-time hours.
Change to Residence and Work Permit for Self-Employment
In this case, you need to have your own business project or register as self-employed. The requirements for this residence and work permit for self-employment include submitting a business plan explaining the project and financial solvency, meaning that you have sufficient means to finance the project. Another requirement is to submit your personal curriculum vitae and a certificate from the Association of Self-Employed Workers affirming that the project is viable.
