Visa for Digital Nomads and Startups

Great news!

In a very short time, we will have a completely new law for startups in Spain, and it involves significant updates in immigration matters.

With this law aimed at boosting and developing entrepreneurship in the country, a new visa will be created for digital nomads and foreigners who telecommute from Spain.

We’ll tell you all about it in this post about the visa for digital nomads and startups!


New Startup Law

While it is true that many startups have emerged in Spain in recent years, the related legislation was not up to par.

But this could change fairly quickly.

Over the past few weeks, the government has released a draft bill that is currently in the public consultation stage with the aim of revolutionizing Spain’s legislation related to entrepreneurship.


The specific objectives of this new startup law are:

  1. Promote the entrepreneurship ecosystem in Spain by making it easier and enhancing the development of innovative technological organizations.
  2. Attract foreign investment and talent to the territory.
  3. Transform Spain into a hub for universal entrepreneurship.

To achieve these goals, it is recommended to provide significant tax incentives to startups and foreign workers, facilitate investment, regulate the sector more favorably for its development, and, as discussed in this article:

  1. Introduce a new visa for digital nomads or remote workers relocating to Spain.

The objectives outlined in the new Startup Law are:

  1. Promote the creation, growth, and relocation of new companies in Spain.
  2. Attract new talent and international capital to the country.
  3. Foster public and private investment in emerging companies.
  4. Improve the interaction between companies.
  5. Promote closer ties between vocational training, universities, and companies.
  6. Assist and improve the transfer of knowledge from universities and public research organizations, public agents of the Spanish system of science, technology, and innovation to the business world.
  7. Eliminate gender gaps.
  8. Support development between companies and investors.
  9. Promote innovative public procurement with emerging companies.
  10. Ensure the effectiveness and coherence of the entrepreneurship support system.


Who is the new visa for digital nomads aimed at?

Until now, many foreigners faced a problem. While they weren’t going to engage in any economic activity in Spain, in many cases they still wanted to continue working for a foreign company or providing services to customers worldwide while enjoying the Spanish lifestyle. The non-profit residence permit was the most suitable option in such cases, but it had the drawback that it did not allow any type of economic activity.

However, all these foreigners will now have it quite simple, as with the new visa under the startup law, they will find the perfect way to regularize their situation. In this way, we identified three different profiles of foreigners who could benefit from the new residence permit: Foreigners who telecommute from Spain (remotely) for an organization outside the Spanish region. The so-called digital nomads, individuals who often have various online income sources and travel from one territory to another.

Additionally, it is expected to integrate a visa for individuals working in a foreign organization located in Spain, including the audiovisual sector.

Digital native application documents

Here are the required documents for the digital nomad application:

  1. Copy of the complete passport or valid travel document.
  2. Proof of payment of fees.
  3. Signed application form by the telecommuter.
  4. Proof of employment relationship.
  5. Proof of real and continuous activity.
  6. Letter from the company.
  7. Copy of the qualification related to the job position.
  8. Enrollment in Social Security.
  9. Certificate of criminal record.
  10. Medical insurance.
