Immigration Rights in Spain

Spain offers various residency permits for non-EU citizens who are residing in the country without authorization. These permits are known as «arraigos» and are designed to provide a path to regularization for those who have established roots in Spain. Here’s an overview of the four main types of arraigo:

Arraigo Social

Arraigo Social is a residency permit granted to non-EU citizens who have been living in Spain for at least three years continuously and can demonstrate social and economic integration into Spanish society. The requirements for Arraigo Social include:

  • Three years of uninterrupted residence in Spain: This means having lived in Spain for at least three years without leaving the country for more than 90 days at a time.
  • Social and economic integration: This can be demonstrated through various factors such as having a stable job, owning a property, having children enrolled in Spanish schools, or participating in community activities.
  • No criminal record: The applicant must not have any criminal convictions in Spain or their country of origin.
  • Financial means: The applicant must have sufficient financial means to support themselves and their family without relying on state benefits.

Arraigo Familiar (Family Roots)

Arraigo Familiar is a residency permit granted to non-EU citizens who have close family ties in Spain. The requirements for Arraigo Familiar include:

  • Family ties in Spain: The applicant must have a spouse, partner, or children who are Spanish citizens or EU citizens with a permanent right of residence in Spain.
  • Two years of uninterrupted residence in Spain: The applicant must have lived in Spain for at least two years continuously.
  • Financial means: The applicant must have sufficient financial means to support themselves and their family without relying on state benefits.
  • No criminal record: The applicant must not have any criminal convictions in Spain or their country of origin.

Arraigo Laboral (Work Roots)

Arraigo Laboral is a residency permit granted to non-EU citizens who have a valid work contract in Spain. The requirements for Arraigo Laboral include:

  • Valid work contract: The applicant must have a valid work contract for at least one year with a full-time or part-time work schedule.
  • Social Security affiliation: The applicant must be registered with Social Security and have been making contributions for at least six months.
  • No criminal record: The applicant must not have any criminal convictions in Spain or their country of origin.

Arraigo para la Formación (Training Roots)

Arraigo para la Formación is a residency permit granted to non-EU citizens who are enrolled in a vocational training program or higher education program in Spain. The requirements for Arraigo para la Formación include:

  • Enrollment in a training or education program: The applicant must be enrolled in a vocational training program or higher education program that leads to an official qualification in Spain.
  • Financial means: The applicant must have sufficient financial means to support themselves and their family during their studies.
  • No criminal record: The applicant must not have any criminal convictions in Spain or their country of origin.

Important Considerations

  • The application process for each type of arraigo can be complex and requires the gathering of various documents. It is advisable to seek legal assistance from an immigration lawyer to navigate the process and ensure that all requirements are met.
  • The duration of the initial residency permit granted under arraigo is usually one year, but it can be renewed if the applicant continues to meet the requirements.
  • After obtaining a two-year residency permit, arraigo holders may be eligible to apply for permanent residency in Spain.

These arraigo permits offer non-EU citizens a pathway to regularize their immigration status in Spain and build a stable future in the country. By understanding the requirements and seeking professional guidance, individuals can increase their chances of successfully obtaining an arraigo residency permit and integrating into Spanish society.
